The only way to protect a name would be to trademark it. I don't think GA trademarked it, so legally, yeah, but ethically??? Pretty shady if you ask me.:rude:

It's not a scam, he's selling real glass, he's just using a reckognized (but unprotected?) trade name for gathering hits to his auction. The description says it's seconds quality NS color.

I agree it's unethical. But it's legal...for the moment.

I was under the impression that "first use" is usually sufficient to protect a trade name, even if it isn't officially trademarked. But getting an injunction and all the rest would probably be more trouble than it's worth.

Not really. The first to trademark it is the one with the rights. It isn't right, but its the law. There can be a challenge to the trademark by the person who used it first and that is usually fought out in court.

Same thing as using a trademark in a totally different market, the person who owns the trademark can enforce non-use even if there is no competition -- they own the trademark, period, for whatever use they wish to put it to.

I have just won one of that auctions for some glass color rod. Are you guys saying that this shit in ns glass? should I b pissed? I thought it was a decent deal since i am starting to get back into glass. I am focusing on beadwork and leaving the tube work for later. thought some of those colors seemed cool. I would be bumed if they were some homemade color labled as ns glass. funny Instantly i had 2nd chance offers of the 4 colors i didnt win making me think he was trying to bump up my bid price and it back fired. anyways i bought a 4 # bag of ns shorts to get me going. long winded posted fueled by coffee. sorry

No, what you got is NS, it's not Glasstique, which was a GA thing....well, if you want to know, search Glasstique here and check out the threads.
