Welp... figured is what "when" not "if" ...

around 4pm yesterday cops showed up at my house with a search warrant. There was like 30 of 'em.... nothing I could do or say really.... they gave me 5 minutes at the door to call a lawyer.

9 years down the drain.

240 plants, "intent to produce" another 400, 6# hanging, 2# bagged, meter tap (electrical theft), firearm up-charge, paraphernalia, and whatever else they decide to heap on my ass - code violation, tax evasion...

fucked.

Surprisingly they only arrested me on site and OR'd me at the scene and gave me a court date on the 12th. guess that's something.

Sorry to hear that man. At least your out for now, which is good. Hopefully you were smart enough to stash the cash, and can afford a good lawyer. I did 3 years in the feds for manufacturing MDMA. Hopefully the feds pick this up, they will go easier on you than most states. If the feds do pick it up and you have any questions about how all that shit works, let me know. Ill try to help the best I can.

EDIT: I just reread your post. Im fairly certain the feds pick up most drug cases involving guns (around here atleast) The gun thing really fucks you in the fed system. It makes you ineligible for the drug program which can reduce your sentence by up to a year. Also I think it raises your custody level but im not entirely sure on that.

A firearm upcharge as its coined here is where if you have a firearm while conducting a felony, its extra time and you get more of a sentence. The trick to that one is that if its used for skeet shooting, competitive use, etc then its not a real charge, only really for illegally owned guns or guns that are loaded near a bunch of cash or bags of weed.

But yea, anyway its likely an april fools joke because he would not have been ROR'd especially with 8 pounds of herb allegedly dry plus more plants than the feds need times 5 to give you mandatory minimums, and the county/town/city/stateies wouldnt even do anything with it, they'd have the feds prosecute it as the weight and plant count would be above their prosecution limitations.

(Kinda like Willie Nelson being in town court for his pot charge, but if he had 6+ ounces they would have had to turn him and the evidence to the next courts up)



Not to mention publishing what you were caught with and admitting to it like this in a public forum with a business name and telephone number would also be INCREDIBLY retarded, ergo April Fools. :)

hopefully this is your first felony, if so there is still hope. I thought for sure I'd be locked up, I got caught Dec 7 of last year, but here I am. If so don't spend money on a high priced lawyer, do some research, and find out who is a respected, or well liked by the court system, this will do more than a 10g attorney will. And pass your first drug screen!, or you will be in treatment. (first felony they must offer you treatment instead of conviction-federal law)
